A Resolution of the Board of Harbor Commissioners of the City of Los Angeles relating to Special Motion 1 adopted by the City Council of the City of Los Angeles on August 9, 2002, adopting a Resolution stating the official City position opposing any action by the President and the Administration that would impose a Taft-Hartley injunction against the International Longshore and Warehouse Union, would remove longshore workers from coverage by the National Labor Relations Act, or would send military personnel to the West Coast docks to assist in a lockout of the International Longshore and Warehouse Union longshore workers.
WHEREAS, as stated in the Resolution adopted by City Council, the Federal Government announced that it may attempt to intervene in the labor dispute involving the Pacific Maritime Association and the International Longshore and Warehouse Union by invoking a national economic emergency in order to forestall a strike under the Taft-Hartley Act, or may use the National Guard to prevent such a strike; and
WHEREAS, any official position of the City of Los Angeles with respect to legislation, rules, regulations or policies proposed or pending before a local, state or federal governmental body or agency must have first been adopted in the form of a Resolution by the City Council with the concurrence of the Mayor; and
WHEREAS, the City Council at its meeting on August 9, 2002, adopted Resolution Special Motion 1 opposing any action by the President and the Administration that would impose a Taft-Hartley injunction against the International Longshore and Warehouse Union, would remove longshore workers from coverage by the National Labor Relations Act, or would send military personnel to the West Coast docks to assist in the lockout of the International Longshore and Warehouse Union longshore workers; and
WHERAS, Special Motion 1 has been transmitted to the Mayor for his concurrence; and
WHEREAS, The Harbor Department, a proprietary department of the City of Los Angeles, has the charter created responsibility for the smooth and efficient management and operation of the Port of Los Angeles for the benefit of the people of the State of California; and
WHEREAS, as stated in the Resolution adopted by City Council, “the jobs in the Port are of high quality, due to agreements that have been negotiated over the last fifty-four by the Pacific Maritime Association (PMA) and the International Longshore and Warehouse Union (ILWU)”; and
WHEREAS, as further stated in the Resolution adopted by City Council, “the use of this power, or even the announcement of the intention to use it will and has upset what has been up until now, a level playing field between the PMA and the ILWU”;
NOW, THEREFORE, BE IT RESOLVED, that the City of Los Angeles Harbor Department supports the position taken by City Council contained in the Resolution adopting Special Motion 1 which provides that, “with the concurrence of the Mayor, that by adoption of this Resolution, the City of Los Angeles hereby includes in its 2001-2002 Federal Legislative Program OPPOSITION to any action by the President and the Administration that would impose a Taft-Hartley injunction against the International Longshore and Warehouse Union, would remove longshore workers from coverage by the National Labor Relations Act, or would send military personnel to the West Coast docks to assist in a lockout of ILWU longshore workers.” A complete copy of Special Motion 1 and the Resolution adopted by City Council is attached hereto.
